By downloading, installing, or using the BabyCry AI: Vision Translator mobile application ("BabyCry AI", "the app"), you agree to these Terms of Service. If you do not agree, do not use the app.
1. What BabyCry AI: Vision Translator is
BabyCry AI: Vision Translator is an entertainment and informational aid that uses AI to interpret a baby's visible cues. It takes up to 4 photos of a baby on a parent's command and uses an external AI service (Claude by Anthropic) to produce a plain-language guess about the baby's likely state (e.g. hungry, tired, in pain, wanting attention), along with generic soothing tips.
2. Not medical advice — critical disclaimer
BabyCry AI is not a medical device and not a substitute for professional medical advice, diagnosis, or treatment. The AI output is an opinion produced by a machine learning model based on visual cues; it can be wrong.
If you are worried about your baby's health, behavior, or safety, call your pediatrician, a nurse hotline, or emergency services immediately.
Never delay seeking or disregard professional medical advice because of something BabyCry AI said.
Do not rely on BabyCry AI for decisions about medication, feeding schedules, injury assessment, or any other care decision with medical consequences.
3. Who may use it
You must be at least 18 years old and the parent or legal guardian of the baby you photograph (or you must have permission from the parent/guardian). By using the app you represent and warrant that this is the case.
4. Accounts
After 5 free scans on a device, you must create an account (email + password) to continue using BabyCry AI. You agree to:
Provide a valid email address you control. We will send a verification code to confirm.
Choose a strong password and keep it confidential. You are responsible for all activity under your account.
Choose a display name that is not offensive, impersonates another person, contains profanity, or violates third-party rights. We may rename or revoke a non-compliant display name.
One account per person. Creating multiple accounts to abuse the free-scan limit, the referral program, or any prize is grounds for immediate termination of all your accounts and forfeiture of pending rewards.
5. Acceptable use
You agree not to:
Photograph anyone without their parent/guardian's consent.
Use the app to photograph people who are undressed, in medical distress, or in any situation where photography is inappropriate.
Attempt to send content that is not a photograph of a baby.
Abuse, scrape, or overload the backend.
Reverse engineer, decompile, or redistribute the app other than through the official app store listings.
Manipulate the referral program (see §7) through fake accounts, self-referrals, payment fraud, or any deceptive practice.
We may suspend or terminate access at any time for violations.
6. Subscriptions
BabyCry AI offers 5 free scans, after which a paid subscription is required to continue using the app.
Standard price: $13.99 per month (subject to change with notice).
Discounted price: $2.99 for the next month if you have redeemed the discount tier (see §7).
Free month: $0 for the next month if you have redeemed the free tier (see §7).
All billing is handled by Google Play Billing (Android) or Apple App Store (iOS) under their respective terms.
Subscriptions auto-renew until cancelled in the store. Cancellation takes effect at the end of the current billing period.
Refunds are governed by Google Play / Apple App Store policy. We do not issue refunds directly.
Refunded payments do not count toward referral qualifying. If a payment that previously counted is later refunded, the corresponding qualifying referral is revoked.
Free scans are provided at our discretion and may change without notice.
7. Referral program and rewards
The referral program is offered at our discretion. We may modify or end it at any time with reasonable notice; pending qualifying referrals at the time of any change will be honored under the rules in effect when they were earned.
7.1 What counts as a Qualifying referral
A friend signs up with your unique referral code.
The friend then completes two consecutive monthly subscription payments, both confirmed by Google Play / Apple App Store.
The signup occurs from a device that has not previously been used to create a BabyCry AI account, and from a different device UUID than yours.
Neither the referring user nor the referred user has reversed, refunded, or charged-back either of the two payments.
7.2 Discount track
Qualifying referrals available (not yet spent on a redemption) can be redeemed:
3 available qualifying referrals → next month at $2.99.
4 available qualifying referrals → one full month free.
A successful redemption consumes the corresponding number of qualifying referrals (they leave the "available" balance). The discount applies to your next billing cycle. Discounts are not stackable across the same billing month.
7.3 Gift card track (cumulative — never reset)
Cumulative qualifying referrals (lifetime, regardless of redemptions) unlock Amazon gift cards:
20 cumulative → $150 Amazon gift card.
50 cumulative → $400 Amazon gift card.
100 cumulative → $1,000 Amazon gift card.
Each milestone unlocks once per account, ever. Cards are issued by Amazon to the verified email on your account within 14 business days of crossing the threshold.
7.4 Gift card terms
Amazon gift cards are issued by Amazon and are subject to Amazon's gift card terms (https://www.amazon.com/gc-legal). We are not responsible for any restriction Amazon places on the card.
Cards are issued in United States Dollars (USD) and are redeemable on Amazon.com. Local Amazon storefronts may not accept them; please verify before counting on a particular use.
Cards are non-transferable, non-refundable, and have no cash value.
We may withhold a gift card payout pending fraud investigation, identity verification, or compliance with applicable tax law. Where required by law (e.g., U.S. tax reporting thresholds), we may request additional information before issuing a card.
If your account is terminated for violation of these Terms before a card is issued, the unissued card is forfeited.
7.5 Anti-fraud
To protect the prize pool, we apply automated and manual checks. Behavior that triggers review or revocation includes (without limitation):
Self-referral (referring your own additional account).
Using a device that previously held a different account to sign up under a new code.
Codes circulated between two parties who refer each other.
Unusually clustered signups within a short time window from the same IP, network, or payment instrument.
Subscriptions that are cancelled or refunded immediately after qualifying.
We reserve the right, at our sole discretion, to revoke qualifying referrals, withhold gift cards, and terminate accounts where we have a good-faith belief of fraud or abuse. Decisions about fraud are final.
7.6 Tax
Any tax liability resulting from receiving a gift card is the recipient's responsibility. Where the law requires us to report payouts to a tax authority, we will do so and may request the information necessary to comply (such as a U.S. taxpayer identification number for residents of the United States).
8. Intellectual property
The app, its icon, branding, and original code are owned by the developer. The AI output returned to you is generated on demand and is provided for your personal, non-commercial use.
9. Disclaimer of warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTY, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE AI'S INTERPRETATIONS ARE CORRECT, COMPLETE, OR SUITABLE FOR ANY PURPOSE. WE DO NOT WARRANT THAT THE REFERRAL PROGRAM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF FRAUDULENT ACTIVITY BY THIRD PARTIES.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE DEVELOPER IS NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR EXEMPLARY DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOST PROFITS, LOST DATA, REVOKED REFERRALS, FORFEITED GIFT CARDS, OR ANY HEALTH, SAFETY, OR MEDICAL CONSEQUENCES. TOTAL AGGREGATE LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO USE THE APP IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) USD $50.
11. Termination
You may stop using the app at any time. We may suspend or terminate your account at any time for violation of these Terms, fraud, or non-payment. Upon termination: subscription access ends at the end of the current billing period (no prorated refund); pending qualifying referrals may be revoked; pending gift cards may be withheld.
12. Changes to the service and terms
We may modify, suspend, or discontinue the app at any time. Material changes to these Terms will be posted with a new Effective date and, where reasonably possible, communicated by in-app notice or email.
13. Governing law
These Terms are governed by the laws of the State of Israel, without regard to conflict-of-law principles. Disputes shall be submitted to the competent courts of Tel Aviv-Jaffa.
